The RTA provides for a fine of not more than $5,000 for a contravention of the certain provisions of the RTA or any regulations or a Court Order made under the Act. The sections of the RTA which must not be contravened are:
- termination of a tenancy by a landlord because the tenant made an application, filed a statement under the Act, or made a complaint or inquiry or gave evidence at a hearing under the Public Health Act;
- the landlord failing to provide to the tenant the Notice of Landlord;
- the landlord wrongfully entering the premises;
- the landlord changing the locks without providing new keys therefor to the tenant;
- the landlord requiring a security deposit greater than that permitted or raising the amount once paid;
- the landlord failing to keep the security deposit in a separate trust account and paying the interest as required; and
- the landlord failing to comply with the provisions regarding the return of the security deposit or accounting therefore.
